- Roll Call – Blaine Brienholt, Zach Leavitt, Wayne Cowley, Wes Kirshner present. Lisa White, Josh Peterson and Branden Anderson were excused.
- Conditional Use Permits/Home Occupation Permits
a. Danielle Peterson – To request a conditional use for an animal training facility located at 41 S. 100 E Suite A (C-1 use in a downtown zone) [email protected].
Peterson explained the new business would be for training dogs in the evenings for dogs and their owners. The other tenants in the facility are accountants and an eye doctor, so they would be closed prior to the classes.
Commissioner Kirshner asked what type of training, if it was obedience training for dogs.
Peterson said it would be, including for companion and some service dogs. There is no overnight housing of the animals, with classes running from 6 to 9 p.m.

b. Trudi Torgerson – To request a conditional use to operate Ink Revive Studio – a paramedical tattooing business – out of her home located at 1895 South Cove View Road. (C-1 use in an R1-10 zone)
Torgerson explained the service she will be offering out of her home is for people with stretch marks, scars or other marks they are trying to reduce the appearance of. It’s tattooing skin color to help reduce the appearance of scars caused by trauma.
Commissioner Kirshner asked about the amount of waste generated, which will be minimal.
Commissioner Cowley asked how many clients she would be seeing. There would only be one at a time. In a day there would be up to three people.

c. Tyler Hall to request a conditional use for a jewelry and gold bullion store to be located at 65 E. 1100 S. (C-1 Use in a General Commercial zone)
Hall said he is relocating to the area and moving his business here from Monticello. He will be located in the west portion of the old Paradise Press building, with Farm Bureau Insurance on the east side.

d. McKenzie Bennett to request a conditional use to operate a short-term rental at 970 West Torrey Pines Drive (C-1 Use in an R1-10 zone). 13 of 39 in Zone 3.
Dalan Bennett appeared on Zoom. They are employed with the National Guard, and his employment is taking him to St. George. He said his family still wants to spend time in Richfield. However, when they are not in Richfield, they just want a way to rent out their home and help with the bills.
Commissioner Kirshner said he doesn’t see any problems with it. It will be number 13 of 39, so it is below the threshold.

e. Tyler Boren to request a conditional use to operate a pre-school at 44 W 100 North in Richfield. (C-2 Use in a Downtown Zone)
Boren said they want to conduct a school for children between the ages of 3 and 5 year old with an emphasis on mindfulness. There would be two sessions a week for the 4- and 5-year-olds on Tuesdays and Thursdays, from 10 a.m. to noon and from 12:30 to 2:30 p.m. Then Wednesdays will have a two-hour sessions at the same times with 3-year-olds.
Currently there is a martial arts business in the front of the building, while the preschool will be in the back of the building.
Commissioner Kirshner asked about the pick-up and drop-off arrangements as 100 North is extremely busy. That is his only concern. There are only about three parking spots in front.
Boren said they’ve used parking over by the school in the past for overflow.
The 12-2:30 is also the school hours, so it’s already getting busy, Kirshner said. He asked how many children would be in each class.
There would be approximately 15 children.
Commissioner Cowley asked if there is a way to drop off the students at the rear of the building, utilizing the parking lot behind the movie theater.
Boren said there is an entrance to the back alley, but they’d need permission from one of the property owners to use it.
It’s a horrible area for that type of business, Kirshner said. He said the business is needed, but the location is not a good one.
Deputy Clerk Anderson pulled up an aerial view of the property, showing where the rear parking lot could be utilized for pickup and drop off.
Kirshner said having 15 cars picking up and dropping off at three stalls at the same time is not sustainable. He said he sees near misses in that area nearly every day, as he works across the street. Commissioner Cowley said the parking along 100 North is not convenient.
Boren said they could likely use the back door.
Commissioner Cowley asked if that could be a condition of the use. It would be much more compatible and safer with the pick-up and drop-off scenario.
Commissioner Kirshner said they need to provide some kind of verification that they are using it as the condition stipulates.
Motion: Approve the conditional use permit to operate a preschool at 44 W 100 North, upon the condition that they get permission to enter from the rear (north side) of the building. Action: Approve, Motioned by Wayne Cowley, seconded by Zack Leavitt. Motion passes unanimously with Blaine Brienholt, Zach Leavitt, Wayne Cowley, Wes Kirshner voting aye. - Discussion Items –
General Plan – Discuss the draft version of the housing section of the new general plan. Motion: Table the item until next month’s meeting. Kendall Welch, planning consultant, appearing via Zoom, explained some of the items in the draft chapter of the general plan the commission has for their convenience in reviewing it. She explained what is new and what is being changed, and which colors of text on the document were used for existing and new items. - Minutes Approval –
a. Minutes of October 2, 2024, Planning Commission Meeting.

b. - Other Business
a. Consider a request from Braden Seegmiller to waive the requirement for a portion a fence along the northeast side of the property being developed where it would conflict with the back wall of the Royal Inn.
Deputy Clerk Anderson said by code the developers are required to install a fence along the entire north side of the property. However, they asked for a deferment for some of that fence, as the old Royal Inn is built right on the property line. If a fence were built, it would block some windows and access to some mechanical items. The developers are asking to be allowed to let the fence terminate at the back wall of the Royal.
Motion: Recommend allowing the north fence for the Axiom apartment complex to terminate at the wall of the Royal Inn. Action: Approve, Motioned by Zack Leavitt, seconded by Wes Kirshner.
